Terms of Service

These General Terms and Conditions (Terms of Service) govern the use of EiraSync, the managed LiveSync service operated by Simon Mück (hereinafter "provider", "we"). By registering or using the service, you accept these terms.

1. Provider and contracting partner

Payment processing, invoicing, and tax handling are carried out through Paddle (Paddle.com Market Ltd. / Paddle Payments Ltd. / Paddle.com Inc.) as Merchant of Record (MoR). For the purchase contract for paid subscriptions, Paddle's terms also apply.

2. Scope of service & zero-knowledge principle

EiraSync provides managed synchronisation infrastructure for the community plugin "Self-hosted LiveSync". Obsidian and the Self-hosted LiveSync plugin are subject to the respective licence terms of their authors. EiraSync is an independent third-party service and is not affiliated with the developers of Obsidian or the Self-hosted LiveSync plugin.

Vault contents are transmitted and stored end-to-end encrypted. We have no access to the contents or to the keys required for decryption (zero-knowledge principle). You are solely responsible for securely storing your passphrase and decryption keys. If you lose your passphrase or decryption keys, recovery of the data is technically impossible.

We owe the technical provision of the sync service within the scope of the current service description. A specific percentage uptime (SLA) is not guaranteed. There is no entitlement to specific features, integrations, or future developments unless the essential purpose of the contract is thereby impaired. During any beta phase, features may be incomplete or change. After official launch we aim for stable provision but reserve the right to further development.

3. Registration and account

Use requires registration with a valid email address. Authentication is via magic link. You must protect the devices on which your account and decryption keys are used from unauthorised access.

As a rule, only one trial period is permitted per verified email address and person. Abuse (e.g. automated mass registration to circumvent limits) leads to immediate suspension without compensation.

If you lose access to your registered email address, a manual email change by our support is permitted for security reasons only for paid subscriptions and only after clear proof of ownership (e.g. Paddle invoice number, invoice date, or last digits of the payment method used). For free trial access, email changes are excluded due to lack of verifiability; in that case a new account must be created.

4. Plans, trial, and payment

Currently, the following apply in particular:

  • Trial: 14 days free, 1 vault, no credit card required
  • Monthly: €5.00 per month (up to 3 vaults, 3 GB storage total)
  • Annual: €36.00 per year (same limits; price advantage vs monthly payment)

All prices include applicable VAT where due. Prices and limits may change for future subscriptions; existing subscriptions retain the conditions agreed at the time of order. Paid subscriptions are processed through Paddle. Payment data is not stored by EiraSync. Cancellation and payment management take place in the Paddle customer portal.

5. Early-bird / founding discounts

Offered early-bird or founding discounts (e.g. discount codes) are time-limited. Discounts apply only according to the conditions of the respective Paddle discount code (e.g. one-time discount on the first year). There is no entitlement to a permanent price guarantee for subsequent years unless explicitly defined in the code.

6. Fair use and restrictions

Use is subject to technical limits (including storage space, number of vaults, maximum file size). We reserve the right to apply rate limits and protective measures against abuse or overload of server infrastructure automatically. We may adjust technical limits at any time if required for security, stability, or further development of the service. Use of EiraSync to store or distribute unlawful content is strictly prohibited.

7. Backups and user responsibility

EiraSync is a pure synchronisation service and does not replace independent backups. Synchronisation means that changes (including accidental deletions) are applied on all connected devices. You are expressly responsible for maintaining regular backups of your data on your own local storage media.

8. Term, cancellation, and data deletion

Subscriptions renew automatically according to the conditions stored with Paddle until cancelled. After the end of the paid period or after the trial expires, access to the infrastructure may be restricted server-side (e.g. to read-only access). For unpaid subscriptions (e.g. after failed payment), access may be restricted immediately.

Synchronisation data stored on the server may be irrevocably deleted (purge) at the earliest 30 days after the end of the contract. During this period you have a final opportunity to secure your data through local backups. Local files on your devices are unaffected by server-side deletion.

9. Availability and changes

We aim for high availability but do not guarantee specific uptime. Maintenance, disruptions at subcontractors, or force majeure (in particular outages of infrastructure or hosting providers, power supply, or internet backbones) may affect availability. Where possible we communicate current incidents and maintenance on a status page or by email.

Material changes to the service or these terms will be announced in good time (e.g. by email). If you do not object to changes to the terms within 30 days of the announcement, they are deemed accepted provided you were expressly informed of this consequence in the announcement. Material changes (e.g. price increases, new liability exclusions for existing contracts) legally require your express consent.

10. Support and response times

For technical questions or issues you can contact us at hello@eirasync.app. We endeavour to respond within 48 hours (on Austrian business days). However, there is no contractual entitlement to fixed support response times.

11. Right of withdrawal for consumers

Information on the statutory right of withdrawal is provided during the order process by our partner Paddle. To the extent provided by law and provided the legal requirements are met, the statutory right of withdrawal expires prematurely if you expressly agree at checkout that provision of the service begins before the withdrawal period expires and you confirm that you thereby lose your right of withdrawal. The legally required consent for early commencement of the service is obtained during the order process.

12. Limitation of liability

We are liable without limitation for intent and gross negligence and for damage resulting from injury to life, body, or health. In cases of slight negligence we are liable only for breach of essential contractual obligations (cardinal duties) and limited in amount to the typically foreseeable damage.

To the extent permitted by law, we are not liable for data loss arising in particular from missing backups, operating errors, lost decryption keys, or disruptions outside our control (e.g. due to disruptions at infrastructure or hosting providers used). The limitations of liability also apply for our legal representatives, employees, and vicarious agents. Mandatory statutory liability provisions remain unaffected.

14. Final provisions

For use by businesses or commercial customers, these terms apply accordingly. Individual agreements (e.g. extended support) may be made on request.

Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods, unless mandatory consumer protection provisions at your place of residence conflict.

If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
